Principles for Conflict of Laws in Intellectual Property unveiled at international conference

On 4th and 5th November 2011 Professor Paul Torremans joined his fellow members of the CLIP group in Berlin to unveil the final version of the Principles for Conflict of Laws in Intellectual Property. During a 7 year research project the European Max Planck Group on Conflict of Laws in Intellectual Property (CLIP) prepared a set of principles that deals with all aspects of jurisdiction, choice of law and recognition and enforcement of foreign judgments in relation to intellectual property. The Principles can be used as a model law or as a model for international legislation in this area. They can also provide guidance for judges and arbitrators.

In its recent Lucasfilm v Ainsworth decision the Supreme Court have  already referred to the Principles twice.

The international conference at Harnack House in Berlin was attended by judges from several countries, practitioners and academics from all over the world.

The Principles are available from  CLIP and a comprehensive commentary to the Principles will be published by OUP.
