4.2 Formulating rules Activity 4 should have shown you that the language used for making rules can sometimes make them difficult to understand. Given that we can only comply with a rule if we know what it means, this is a big problem! In this part of the unit we are going to look at the process of making rules in more detail – and you are going to have the opportunity to make a rule that can be understood and which is effective in achieving what it sets out to do. 1 Making, interpreting and applying rules The aim of this unit is to introduce you to the processes of making, interpreting and applying rules. We often think about social rules, most of which are unwritten and which we observe because we have a shared social understanding of what they are. We are now going to think about a different kind of rule. A definition of a rule (as opposed to a habit, custom or role) is shown in Box 1. 5 Conclusion Social work and law are both contested concepts, open to a range of possible meanings, depending on their context and the source of their definition. An understanding of these competing meanings is essential to good professional practice and provides a foundation for examining the relationship between social work and the law which is central to this unit. The relationship between social work and the law is subject to change, as the organisation and delivery of social care services attempts to 2.3 Social work and social change The social work profession in Scotland is undergoing a period of significant change at the beginning of the twenty-first century. In a process which largely mirrors developments across the UK, new systems for the education and regulation of social workers have been introduced to improve standards in the provision of social services, to raise public confidence and protect service users. For the first time entrants to the profession are required to obtain an undergraduate degree in social work, 2.2 Finding out about social work There is evidence that public knowledge about social work in Scotland is ‘fairly low’, with apparent confusion between social services and welfare benefits – ‘the social’ – and over the boundaries between social work and social care. The MORI survey also reported that those most likely to be in need of social support – older people, lower social income and minority ethnic groups – were particularly ill informed about availability and access to services (Davidson and 2,2 The right to confidence Those who allege that their privacy has been invaded commonly rely on the action of ‘breach of the right to confidence’. The common law right to confidence is a recognised right. The essence of the right to confidence may be summarised as misuse of private information. The English courts have established, in numerous decisions, that obtaining or publishing unauthorised photographs or information amounts to a breach of confidence in situations where a ‘duty of confidence’ exi 2.1 The history of the common law Prior to the Norman Conquest of England in 1066, there was no unitary, national legal system. Before 1066 the English legal system involved a mass of oral customary rules, which varied according to region. The law of the Jutes in the south of England, for example, was different from that of the Mercians in the middle of the country (see map below).
