Professor Derclaye delivers EUIPO webinar on the CJEU's Cofemel decision

Professor Derclaye has recorded a webinar at the European Union IP Office on the CJEU’s Cofemel decision (Cofemel v G-Star Raw, case C-683/17). In this webinar, the decision of the CJEU, issued on 12 September 2019, is summarised and criticised. The Court of Justice held that Member States can no longer apply a higher level of originality to works of applied art/designs. The same criterion applies to all copyright works, namely the author's own intellectual creation. The case concerned a jeans and a t-shirt designed by G-Star Raw, the copyright in which it claimed Cofemel had infringed. The webinar includes a discussion of the decision’s potential consequences on the Design Directive and Regulation.
