Professor Derclaye delivers EUIPO webinar on the CJEU's Cofemel decision

Professor Derclaye has recorded a webinar at the European Union IP Office on the CJEU’s Cofemel decision (CofemelG-Star Raw, case C-683/17). In this webinar, the decision of the CJEU, issued on 12 September 2019, is summarised and criticised. The Court of Justice held that Member States can no longer apply a higher level of originality to works of applied art/designs. The same criterion applies to all copyright works, namely the author's own intellectual creation. The case concerned a jeans and a t-shirt designed by G-Star Raw, the copyright in which it claimed Cofemel had infringed. The webinar includes a discussion of the decision’s potential consequences on the Design Directive and Regulation.

The webinar will be streamed live on Tuesday 19 November 9am UK time and later remain available on the EUIPO website.
