Research Topic

The Technical Assistance Saga! Does WIPO have the ultimate recipe for a successful implementation?

This research is primarily a Socio-legal research. It will be looking at the effect of social factors on Intellectual property Law. It will engage the use of Interdisciplinary approach by delving into political science, history, economics and sociology to determine the extent of the influence of culture, history and local politics on the acceptance and successful implementation of Technical Assistance efforts to Developing countries and in particular the Cluster A (technical assistance provision) of the WIPO Development Agenda.

It is important to consult these disciplines to bring into light the social function of the International Intellectual property treaties in place for the protection of Intellectual Property and various obligations that are expected to be met by developing countries.

There will be a comparative study of two developing countries to draw out common issues associated with the implementation of Technical Assistance and Empirical work will be carried out in form of interviews and questionnaires to identify and explore these socio-legal theories. Secondary sources will be consulted which will be mainly library based work to understand the history and relationship between Intellectual property and Development, to analyse the substantive provisions of the major International treaties developing countries are part of, their obligations under them and the consequences of these treaties on the development of intellectual property law in these countries.
