Copyright and the Right to Freedom of Expression: Balancing of Rights in the New Technological Age

The proposed thesis aims to answer the question ‘the main reason behind the ineffectiveness of the Thai copyright law is the failure to protect ‘the right to freedom of expression’ in the country.” It will critically examine the historical concept of constitution as a function of governmental designs. Furthermore, the fundamental idea of human and civil rights will be explored. The research will then extensively analyse how human rights and civil right are reorganised under different constitutions and jurisdictions.

The thesis will be divided into three Parts;

Part I: General and international concepts and fundamental theories of human rights, specifically ‘personal right and property right’ as related to the intellectual property rights of the creators and the right to freedom of expression. The concepts and theories of Constitution as the main body of law that guarantees those rights will also be examined.

Part II: History and development of Thai constitutional law focusing on human rights aspect, in accordance with intellectual property rights, the ‘personal right and property right’ of the creators, the right to freedom of expression, particularly the government’s policy related to social development and public interest. The study will examine the concepts as appearing in the mindset of Thai aristocratsand grassroots people, specifically with regard to the personal right, property right and the right to freedom of expression.

Part III: Critical analysis: focusing on a particular copyrighted work, the study will analyse the concurrence of the right to freedom of expression as appeared under the Thai Constitutions in relation with copyright law and the judiciary’s decisions, in comparison with the UK system.

2008 - Present - Law Lecturer at Sripatum University. Gives lectures to undergraduate law students in Constitutional Law, Intellectual Property Law, Dispute Settlement and Arbitration, Fundamental Rights and Duties, and Legal History.
