A Supplier Review System as part of the Government Procurement System for China
Xinglin Zhang is working in the field of Public Procurement Law. Her research project focuses on studying the supplier remedies system, especially the Chinese supplier review system. She seeks to provide a critical analysis of the current Chinese supplier review system in the field of government procurement law, informed by an analysis of the approach of other systems to this question. By analysing provisions on the supplier review systems contained in the UNCITRAL Model Law on Procurement, APEC Non-Binding Principles on Government Procurement, the EU Procurement Remedies Directives and the GPA of the WTO, which sets different standards for establishing remedies systems in government procurement, and also assessing the advantages and disadvantages of the various approaches used in the above regimes, she finally seeks to identify which of these standards might be appropriate for China to apply and therefore to improve the Chinese system. This research will be done by using doctrinal legal analysis, based on reviewing different sources of law on remedies and on China, the relevant international documents and literature on all of them.
