Climate litigation is increasingly understood as a tool to hold governments and corporations accountable for climate change impacts, and much hope is placed on courts to fill gaps in climate governance. This presentation takes a different perspective, by exploring the complicated (and often messy) institutional context that shapes how climate legal disputes are resolved. Climate change case law is not just an instrumental tool to effect policy change; it is also an important window into how different legal systems are confronting climate change problems.
