Do we need substantive consolidations in the (European) toolbox?

Professor Irit Mevorach participated in a panel discussion organised by the European Law Institute (ELI) - 'Perspectives from the ELI Business Rescue Report, European Insolvency Regulation, and the UNCITRAL Legislative Guide'.

The panel focussed on the usefulness of 'substantive consolidation' as a tool for the resolution of enterprise group insolvencies. The doctrine was discussed by the panelists from different, comparative, perspectives. In particular, professor Mevorach provided a critical overview of the recommendations on substantive consolidation developed by UNCITRAL in the legislative guide on insolvency law.

The event took place on 11 December in Vienna in the Austrian Ministry of Justice, on the occasion of the 54th Session of the United Nations Commission on International Trade Law (UNCITRAL) Insolvency Law Working Group.
