Returning to Work from Shared Parental Leave

Whether you have taken an extended or short period of SPL, you and your manager should make arrangements for your return to make the transition back to work as smooth as possible.

SPLiT Days

You may have agreed with your manager to have attended some SPLiT Days during your time away and before your SPL comes to an end, to attend team meetings, conferences/training sessions or to catch up on developments.

What will happen to my annual leave during SPL?

You will continue to accrue annual leave whilst on SPL.

Can I come back from SPL part-time?

Flexible working requests can be made and should be approached in line with the flexible working policy and discussed with your line manager.

Do I have the right to return to the same job after taking a period of shared parental leave?

When an employee returns to work following a period of SPL they are entitled to return to the same job if their combined leave period (comprising of maternity/paternity/adoption and shared parental leave) totalled 26 weeks or less. This is unaffected by unpaid parental leave of up to four weeks being taken as well. 

In the case where the number of weeks of maternity/paternity/adoption and SPL exceeds 26 weeks in aggregate, or the total number of unpaid parental week exceeds four weeks, an employer must allow an employee to return to the same job unless it is not reasonably practicable, in which case they must offer a suitable and appropriate job on terms and conditions that are no less favourable.

What happens if I decide not to return? 

You must give written notice in accordance with your contract of employment.

What happens f I don’t return after receiving enhanced ShPP?

The University does reserve the right to reclaim the non-statutory element of ShPP, if you fail to return to work following a period of ShPP for at least three months following each period.
