UK Withdrawal from the EU

Advice for EU, EEA & Swiss staff

Information for EEA nationals and their family members already in the UK and those arriving after 31 December 2020.

The UK left the EU on 31 January 2020 with a deal in place, as the European Union Withdrawal Act was passed by Parliament and backed by the leaders of the 27 EU countries. The transition period until 31 December 2020 has now also passed, so while the rights of those already in the UK before the end of 2020 will not change, EU, EEA and Swiss nationals coming to the UK for the first time from 1 January 2021 onwards will need to enter under the correct UK visa route.

Information for Europeans and their family member who were resident in the UK before 31 December 2020

As a deal was agreed before the UK left the EU on 31 January 2020, the rights of EU, EEA and Swiss nationals and their family members who were resident in the UK before the end of the Brexit transition period on 31 December 2020 remain the same.

EU, EEA and Swiss nationals and their family members who were resident in the UK before the end of the transition period (31 December 2020) must apply for Pre-Settled or Settled status before the 30 June 2021 deadline. See the Home Office web site for more information on continuing to live in the UK.

Pre-Settled status is granted to those who have been living in the UK for less than five years, Settled status is granted to those who have lived in the UK for five years or more.

EU, EEA and Swiss nationals and their family members coming to the UK for the first time from January 2021 onwards will need to apply or enter under the appropriate UK visa route.

Irish nationals do not have to apply for anything as they automatically have settled rights in the UK under ‘Common Travel Area’ (CTA) arrangements, which date from before Ireland and the UK joined the EU.

Information on the different UK visa routes can be found here.
