Responsibilities of Sponsored Workers

On 29 February 2008, the UK Government introduced new legislation in respect of the prevention of illegal working. This established a regime of civil penalties to be imposed on employers of illegal workers, and a criminal offence of knowingly employing an illegal worker.

The main provisions for sponsored workers are that you have a duty to undergo initial and ongoing checks of your documentation and you have a responsibility to report any change in your circumstances.

Guidance and Duties for Sponsored Workers

We require that you report any of the following activities to the HR Staff Immigration Team in order for us to report this activity to the UKVI for the duration of your employment and sponsorship with us.

Maintaining up-to-date contact details

It is important that you notify HR immediately of any changes to this information.  You should complete the online form as soon as possible when you arrive in the UK and when your contact details change during your employment.  If you update your details directly using MyView, you must still notify the HR International Employment Services Team using the online form or by email (BR-StaffImmigration@exmail.nottingham.ac.uk) so that the change can be reported.

Unauthorised absence

You must report any periods of unauthorised absence to the HR International Employment Services Team by email (BR-StaffImmigration@exmail.nottingham.ac.uk).  Please note that unauthorised absence does not include authorised annual leave, sickness absence which has been appropriately reported through the University’s sick absence reporting procedure or any other leave (such as compassionate, parental, maternity, study etc), authorised under a University process.  You should ensure that you are aware of the process for reporting all forms of leave, including annual leave.  It is very important that you comply with the appropriate leave procedures as we may have to report your unauthorised absence to the UKVI.

Change of Circumstances

Please complete the online form to notify the HR International Employment Services Team of any changes to your circumstances (such as changes to job title, salary, work address, job duties, working hours). Please note that we have a duty to report a change in circumstances to the UKVI within 10 working days of the effective date.

Important Information to Note

In addition to the above reporting requirements, you are required to comply with the terms of your visa at all times. You must not undertake any work (whether paid or otherwise) that is not permitted by your visa. If your visa restricts the number of hours per week you are permitted to work, you must not exceed that number in total. The restriction applies to paid and unpaid work and is cumulative across employers. The number of hours is per week (Monday to Sunday) and cannot be averaged over a longer period. If you are offered additional hours or overtime, you must only accept work hours up to your maximum permitted for that week. If you have any Unitemps assignments at the same time as your employment with the University, your Unitemps assignments will be restricted to the permitted weekly hours of work less your weekly contracted hours with the University.
